A Second DWI Arrest In Texas Requires An Aggressive Legal Response
Driving while intoxicated or driving under the influence is a class B misdemeanor under state law, and a conviction can include jail time and large fine. This punishment is designed to convince you never to commit the crime again, becoming a habitual offender. If you have been arrested for another DUI offense within three years of your first arrest, the penalties you could face are significantly greater.
Under Texas law, the sentencing for DUI convictions increases in severity according to the number of prior convictions on the defendant’s record. Penalties for multiple DWIs include:
Second offense: Class A misdemeanor with a $4,000 fine and at least 30 days in jail
Third offense: Third-degree felony, which carries a two- to 10-year prison sentence and can cost you up to $10,000 in fines
Any repeat DWI offender must also pay $4,500 for surcharges under the state’s Driver Responsibility Program.
